Definitions
The Photographer: Claire Dukatz & Claire Dukatz Studios
The Client: Any person, body of persons, or company with whom the photographer enters into a contract for the sale of goods or provision of services by the photographer
Booking & Payment
A $50 non-refundable booking deposit is required for all sessions. The deposit will be applied towards the session fee. Your remaining balance must be paid (cash, Paypal, or Venmo) at the time of your session.
Performance of Services
The photographer agrees to
take photographs per client’s request, allowing for artistic expression
create high quality photographs ideal for print or web display
professionally edit digital images to represent photographers artistic style
deliver to the client a digital album of images within two business days unless stated otherwise in writing
Copyright and Reproductions
Client acknowledges that images may be retained and used for future marketing purposes or for display in photographers portfolio whether in print or online. The photographer shall own the copyright on all images created and shall have the exclusive right to make reproductions and edits of any kind. The Photographer shall only make reproductions for the client or for the photographers portfolio, samples, self-promotions, entry in photographic contests or art exhibitions, editorial use, or website.
Clients Usage
The client is obtaining photography services for personal use only, and shall not sell said prints. If client is obtaining a print for newspaper announcement of the wedding, editorial use or website, photographer authorizes client to reproduce the print in this manner. In such event, client shall run a credit for the photographer adjacent to the photograph. If client is obtaining photography services for commercial use, client shall give photographer credit where applicable, and agree to post advertisements and/or business cards on behalf of the photographer at their place of business.
Client is never permitted to edit or alter any photo that is copyright of Claire Dukatz Studios.
Cancellation Policy
A notice of two days must be given for cancellation of this contract by the client. The booking deposit is not refundable. Any cancellation made with less than 48 hours notice will result in full payment by the client. If cancellation is initiated by the photographer, all monies including booking deposit will be returned within 48 hours from the time of cancellation.
Health & Safety
Claire Dukatz Studios reserves the right to terminate coverage and this contract, and leave the location of the session if the photographer experiences inappropriate, threatening, hostile, or offensive behavior from the client or others.
Regarding Covid-19, Claire Dukatz Studios will comply by all local and state guidelines. The photographer will wear a mask for the entirety of the session and will maintain an appropriate distance when feasible. By attending the session, client acknowledges that the client has had no known exposure to Covid-19 within the past 14 days. If exposure is suspected client must notify photographer. Claire Dukatz Photography will make every effort to accommodate and reschedule sessions impacted by Covid-19.
Image Archive
All images will be available for purchase or download for one year following the session date. After one year images may be purged from the hard drive and no longer available for
access. Photographer may retain certain images for promotional purposes. Photographer is not responsible for storing images beyond one year from the date of delivery. It’s recommended that the client saves images to a physical data-storage device, ie. usb flashdrive.
Liability
Photographer is not responsible for any damage to person(s), or property during or in-relation to the session. Client is responsible for the safety of their own children, pets, family, property, etc. Client releases photographer of any and all liability.
